Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Planterium, meaning the website, applications, and services we provide (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service. Planterium is made and run by SplitHare Software, and “we” and “us” in these Terms mean SplitHare Software.

1. Your account

You need an account to use Planterium. You are responsible for the activity that happens under it and for keeping your credentials secure. You must provide accurate information and be at least 13 years old (or the age of digital consent where you live) to create an account.

2. Your license to use the Service

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for planning and managing your own gardens. This license does not allow you to resell the Service, to copy or redistribute its content (including our plant catalog data and artwork) outside the Service, or to use the Service to build a competing product.

3. Your content

Your gardens, plans, plantings, notes, and any imagery configuration you create remain yours. You grant us the limited rights needed to store, process, back up, and display that content to you, which is what running the Service requires. We do not sell your content, and we do not use it for advertising.

4. Free and Premium plans

The free plan includes one garden and a curated set of classic cultivars. Premium features (including the 3D view, sun & shadow simulation, aerial imagery, the full plant catalog, trees, structures, decorations, and multiple gardens) are part of a paid subscription. Where a feature moves from free to Premium, anything you have already planted stays visible and yours. Pricing and feature boundaries are described on the pricing page and may change; we will communicate material changes before they take effect.

5. Premium billing

Premium is a paid membership, billed monthly or yearly, charged up front through Stripe. You can cancel any time from Settings; Premium stays on until the end of the time you paid for, and you are not charged again. If a renewal payment fails, we will try the card again for a short while before Premium switches off. If something went wrong with a charge, write to [email protected] and we will put it right, including a refund where that is the fair thing to do. Receipts come from Stripe and show the name Planterium. If you delete your account, your membership is cancelled at the same time and you are not charged again.

6. Acceptable use

  • Don't attempt to break, overload, probe, or reverse-engineer the Service.
  • Don't access other users' data or attempt to bypass plan limits or feature gates.
  • Don't use automated tools to scrape the catalog, artwork, or other content.
  • Don't use the Service for anything unlawful.

7. Third-party services

The Service is built on third-party infrastructure (such as hosting, database, and map/satellite imagery providers). Aerial imagery is provided for on-screen display within your plan and is subject to the imagery provider's terms. We are not responsible for third-party services, but we choose them carefully.

8. Gardening disclaimer

Planterium provides planning estimates. Frost windows, sowing dates, spacing, sun-hour simulations, and harvest projections are informed estimates, not guarantees. Weather and soil will do what they want, and we are not liable for crop outcomes.

9. Termination

You can stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms. On deletion, we remove your content from production systems within a reasonable period, subject to backups that age out.

10. Warranties and liability

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, and our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose (or $50 if you have paid nothing).

11. Changes to these Terms

We may update these Terms as the Service evolves. If a change is material we will give notice in the app or by email before it takes effect. Continuing to use the Service after a change means you accept the updated Terms.
